“The staff in question –responds the councilor Darío Falzone– was hired with European funds that could not be used neither for the increase in working hours, nor for the transition to full-time of those who are already interns; For this, the institution’s own resources are needed. Unfortunately there is a confusion between two things that have nothing to do with it, the officials in question actually have fixed-term contracts because their contracts already expire this year.
The union, however, takes advantage of the ruling issued by the Ombudsman who, based on some rulings, specifies that “in the presence of specific ex lege conditions, the right of precedence corresponds to part-time workers.” And therefore “it does not seem possible to reasonably exclude the validity of the claims of part-time workers, from which it follows that in the event of a possible conflict there is a real risk of loss of the administration”. “But it is an opinion that refers to part-time staff who aspire to full-time -responds Councilor Falzone- It has nothing to do with those who are hired for only a few months.” A topic that has also landed in the town hall for some time.
“We have already started talks with the Ministry of Labor by sending a substantial report – Usb representatives continue – and we are ready to take legal action to protect workers. The Municipality runs the risk of having to pay adequate compensation for damages that would constitute real and concrete fiscal damage, also considering that the institution is close to approving the rebalancing plan. That is why we are also preparing a note to be sent to the MEF and the Court of Accounts. The norms do not show a difference between budgetary and non-municipal resources, nor between temporary or indefinite contracts.
